Terms of usage

  1. Upon registration of your user account, it shall be deemed that you have fully understood, acknowledged and agreed to the terms and conditions of usage hereinafter set forth.
  2. In using our Application, you risk your account being suspended, terminated, removed or banned without prior notice to you if it is found at any time for any reason whatsoever that your user account is associated or linked with any of the following prohibited activities: –
    • Transmit content or information via our Application which is found to be unlawful, defamatory, libelous, threatening, offensive, obscene or which may contain profanity, pornography or may be construed to be racially offensive;
    • Use or access our Application and/or information therein:
      • To conduct any fraudulent, illegal or criminal activities including without limitation money laundering or acts which violate the law;
      • That degrades or may degrade the operating performance of our Application; and/or
      • In any way that interferes or may interfere with the usage and enjoyment of other users;
    • In any way adapt, reproduce, copy, modify, store, duplicate, display or publish or transmit, sell, lease or rent to any third party any content or information contained in our Application;
    • In any way obstruct the proper use and/or the provision of our services via our Application including without limitation sending/forwarding spam or mass mailings, uploading, spreading or distributing files, content, data or information which contains or may contain viruses which may affect, damage and/or disrupt our online servers, database or systems; and/or
    • Use Artificial Intelligence, external software and third-party programs or any other software which confers an unfair disadvantage to other users when dealing with our Application, whether commercially acquired or privately developed.

User Account & Registration

  1. You will be provided with a link for your user account verification and will also be prompted to reset your initial password for security reasons when you register with us.
  2. You are not be permitted to change your username upon successful registration. For requests of cancellation of your account, kindly write in to us at cosmic@mydbs.asia.
  3. You are only permitted to maintain with us only one user account per person whereby in any event of suspicion or discovery of multiple user accounts managed or used by/under a single user, we reserve the right in our sole discretion to consolidate all such accounts into one, terminate, suspend or remove your user accounts.
  4. The safekeeping of your personal login credentials, banking/card particulars and any other confidential information shall at all times be your sole responsibility and we shall not be liable for any stolen or lost login credentials. Should you have any queries or require a change in your password, please contact our support team cosmic@mydbs.asia. for further assistance.
  5. We may from time to time require you to provide proof of your age/identity or any other documents which may be required for varication purposes of your membership with us. Any changes to your personal data shall immediately be communicated to us in writing.

Top-Up of Funds & Payment

  1. All your funds will be stored and held in your e-Wallet which may be accessed, managed or monitored by navigating through the homepage of our Application.
  2. In order to top-up funds, you must click the “top-up” option below your e-Wallet, fill in the required information and enter the integer amount of top-up. Upon confirmation following the online banking prompt, such amount will be reflected in your available e-Wallet balance.
  3. When using a credit or debit card for any in-app transaction, the name of the cardholder must be the same as the name registered with your user account. In the event of discrepancies in the names of the cardholder and the user account, we reserve the right to decline such transaction.
  4. Any requests for withdrawal of funds shall be made to our finance team Info@mydbs.asia in writing and will be reviewed before processing of any withdrawal of funds. You are encouraged not to store excessive funds in your e-Wallet and to only recharge the necessary funds sufficient for the intended purchase or booking.
  5. We may from time to time conduct any identity, credit and/or other verification checks on any activity on your account at any time and you hereby agree to provide all information we require in order for us to carry out such verification checks.

Special Offers & Promotions

  1. All special or seasonal offers, promotions and/or packages offered via our Application are governed by these terms of usage in addition to the specific terms and conditions of the offer.
  2. We reserve the right to: (a) amend, modify or make additions to the terms and conditions of such promotional offers at any time we deem necessary; or (b) implement any unilateral decision to modify, cease, defer or cancel any promotional activities at any time without prior notice to you.
  3. Where you have abused or attempted abuse of any promotions or offers available on our Application or in any way cheated or attempted to cheat/scam us, your user account may be temporarily suspended for investigation purposes. If we find there is a high likelihood you have committed such action, we will impose a permanent ban on your user account whereby all credits in your account will be forfeited as our liquidated damages.

Updates, Fixes & Rectification

  1. We have the right in our discretion to update, modify, delete, rectify, or change any part of any of our Application including without limitation the terms and policies herein at any time as we may deem it necessary.
  2. You will receive in-app notifications on the significant changes which may affect or concern your usage of our Application. Your continued use of our Application after implementation of such changes constitutes your acceptance of such changes.
  3. You will be prompted via in-app notifications prior to our application updates, bug/glitch fixes and regular server or system maintenance which are undergone to optimize your user experience and ensure smooth interaction with our Application.

Copyrights

  1. We, along with our third-party service suppliers/providers, reserve all copyrights pertaining to our Application whereby our Application, including without limitation all texts, graphics, user and visual interfaces, pictures and photographs, logos, trademarks and artwork are the exclusive property of DBS Asia Management Sdn. Bhd.
  2. You as a user of our Application are granted a limited, non-exclusive and non-transferrable permission to access and use our Application solely for personal, non-commercial purposes. Any unauthorized use, reproduction, modification, distribution, display or transmission of any of content on our Application is strictly prohibited.
  3. By using our Application, you agree and acknowledge not to violate any copyrights or intellectual property rights which may result in suspension or termination of your user account and/or legal consequences.
  1. We will at all times and at our best endeavors strive to protect and safeguard your personal data stored in our servers. Notwithstanding this, we shall not be held liable for any claims, liabilities, losses, damages, or expenses incurred or suffered, whether directly or indirectly, as a result of any forgotten or loss of passwords/login credentials, misappropriation or theft of your personal data and/or any unauthorized access or security breaches or cyber-attacks to our servers, systems or databases.
  2. The information via our Application is provided for informational purposes only and shall not, under any circumstances, be construed as legal, financial, medical or professional advice. Reliance on any of the information provided on our Application is at your own risk. It is recommended that you consult a qualified professional for any specific advice you may require.
  3. We do not guarantee the accuracy, reliability and correctness of the information provided on our Application as they may contain typographical errors or inaccuracies which may be modified, rectified or updated by us at any time.
  4. We do not endorse or assume any responsibility for any products, content or actions by third-party service providers for any links which may be contained in our Application. You acknowledge and agree that you shall not hold us liable, whether directly or indirectly, for any damages or losses suffered or incurred by you arising from your use of or reliance on any third-party information, content, product or services.
  5. In no event will we be liable for any claims, liabilities, fines, penalties, damages or losses arising from in connection with interference or corruption of any device or data, delays or errors in the server or the system or your use of our Application.
  6. Our Application is not intended for the use of children under the age of 13. We shall deem that all placement of orders and usage of our Application are made by an adult or a minor under supervision of an adult. Any information provided to us by a child under 13 will be promptly deleted from our servers in the event we become aware of the same.
  7. All items (products, events and services) performed or delivered are deemed sold and we do not endorse or hold any responsibility nor liability or guarantee in relation to any products, content, events, services or actions that are provided, managed or hosted by any third-party or our affiliates.
  8. The Application may contain links to third-party websites solely for your convenience whereby we are not responsible for ensuring the accuracy, the truth and/or the currency of any content or information therefrom
  9. All payments shall only be deemed received upon full payment being credited into our Account. All pending or floating payments or uncertified statements or receipts will not be entertained.
  10. Our total liability to you in its entirety, whether in contract, tort or otherwise shall be capped at a maximum of the actual transacted amount of the specific transaction.
  11. We will commence legal action or any specific relief as may be available against you for any breach of the terms or policies of usage herein and/or claim from you any damages, costs or expenses incurred or suffered by us as a result therefrom.
  1. In addition to the terms and policies of usage above, I hereby solemnly and voluntarily make the following declarations, representations and warranties: –
    • That I am over the age 18 and I have read, fully understood and accepted the terms and policies of usage of the Application which form a legally binding agreement between us;
    • That I am bound by all laws of Malaysia and have not committed any illegal, criminal or unauthorized acts
    • That all information provided by me during registration of my user account are accurate, true and complete;
    • That all actions done through or with my user account represent actions of myself only and not others whereby I shall fully be responsible for all activities performed through your username, account number and password;
    • That all funds stored or deposited in my e-Wallet are not illegal or unauthorized funds;
    • That my use of and access to your Application including without limitation downloading or installation of software and participation in our special promotions/offers is not prohibited by any law; and
    • I fully understand the risks of downloading, engaging with and using your Application.

Accuracy Of Information

  1. I hereby voluntarily sign up and use your Application and further declare and confirm that all my personal information and data provided by me are accurate, true and correct and that I have read, understood and accepted all the terms and conditions contained in the policies set out in this Application.

Know Your Client (KYC) Requirements

  1. I hereby acknowledge that a CTOS and CCRIS search may be conducted on me or my related parties, directors and/or my affiliates satisfactory to you and agree to furnish you any documents or information required to ensure that statutory provisions such as the Anti-Money Laundering legislation, etc. are complied with if so requested by you in order to meet the “know your clients” requirements.
  2. Pursuant to the Credit Reporting Agencies (CRA) Act 2010 and Central Bank of Malaysia Act 2009, I do hereby give my consent to you and CTOS Data Systems Sdn Bhd (“CTOS”), a registered credit reporting agency under the CRA Act to process my personal data or my company’s personal data.
  3. By this consent, I understand and agree that credit/trade checks including CCRIS checks on me or my company may be conducted and when consent has been given individually, on such other relevant parties with CTOS at any time for as long as I have a trade relationship with you.
  4. I am aware and understand that any information on me or my company may be disclosed to any business entity for bona fide trade checking at any time and that such information will be provided to CTOS, who may in turn share such information to subscribers of their service.
  5. I hereby give my consent to you and CTOS to disclose my/my company’s information for the processing of my/my company’s application to any processing centre outside Malaysia and to process such personal data as per the provisions of the Personal Data Protection Act 2010.
  6. I hereby declare that I am not a bankrupt nor in connection with any offences related to anti-money laundering and anti-terrorism.

Indemnity

  1. I hereby agree that under any circumstances to indemnify and hold harmless DBS Asia Management Sdn Bhd, its officers, directors, employees, agents and affiliates from any claims, liabilities, fines, penalties, damages or losses resulting or arising from my breach of the policies herein, misuse of any products, services or event tickets purchased through your Application or violation of any applicable rules, regulations or laws, including any costs incurred by you in recovering such funds in the process.
